Supreme Court Decision
Sparks Pro-Abort Fears of Demise of Roe v. Wade

WASHINGTON, D.C., January 25,
2010 (LifeSiteNews.com) – The
United States Supreme Court last week struck down campaign finance
laws that restricted the political spending of corporations and labour unions
in a 5-4 ruling that has been condemned by President Barack Obama and hailed
by others as a victory for free speech.
But for pro-life advocates the
ruling is of especial interest, since it reversed decades-old precedent
of the court, sparking fears among abortion proponents that the
precedent established by Roe v. Wade could also be vulnerable.
The majority of the court sided
with Citizens United, a conservative group who produced “Hillary: The
Movie” to criticize then-presidential candidate Hilary Clinton during the
2008 Democrat primaries. Citizens United intended to promote the film
through cable television ads, but the Federal Election Commission decided that
these were equivalent to campaign ads, and so the group could only fund the
project through individual contributions rather than corporate funds.
Last week's judgment, in part,
struck down sections of the 2002 Bipartisan Campaign Reform Act, allowing
unions and corporations to put out issue-related ads in the days leading up to
an election.
Justice Anthony Kennedy,
writing for the majority, stated that there is "no basis for allowing the
government to limit corporate independent expenditures."
"There is no basis for the
proposition that, in the political speech context, the government may impose
restrictions on certain disfavored speakers," he wrote. "The
government may regulate corporate speech through disclaimer and disclosure
requirements, but it may not suppress that speech altogether."
The four dissenters were
Justices John Paul Stevens, Ruth Bader Ginsburg, Stephen Breyer and Sonia
Sotomayor. Writing on their behalf, Justice Stevens argued that the
Court should not confuse corporations with individuals.
"The notion that the First
Amendment dictated [the ruling] is, in my judgment, profoundly
misguided," he wrote. “In the context of election to public
office, the distinction between corporate and human speakers is significant.
Although they make enormous contributions to our society, corporations are not
actually members of it.”
The political left have harshly
condemned the ruling, saying that it will allow the concerns of special
interest groups to supersede those of ordinary people. Leading the way,
President Obama dedicated his weekly address on Saturday to the matter.
“This ruling strikes at our
democracy itself,” Obama said. “This ruling opens the floodgates for an
unlimited amount of special interest money into our democracy. It gives the
special interest lobbyists new leverage to spend millions on advertising to
persuade elected officials to vote their way — or to punish those who
don’t.”
“We don’t need to give any
more voice to the powerful interests that already drown out the voices of
everyday Americans,” he added.
In the wake of the ruling,
however, abortion proponents have expressed their fear over the Supreme
Court's willingness to overturn seemingly established precedent, motivated in
particular by a concurrence opinion issued by Chief Justice John Roberts.
Roberts wrote that 'stare
decisis', the principle that requires judges to follow precedent established
by previous decisions, “is neither an ‘inexorable command’… nor ‘a
mechanical formula of adherence to the latest decision’ … especially in
constitutional cases.”
“If it were, segregation
would be legal, minimum wage laws would be unconstitutional, and the
Government could wiretap ordinary criminal suspects without first obtaining
warrants,” he wrote.
“When considering whether to
re-examine a prior erroneous holding, we must balance the importance of having
constitutional questions decided against the importance of having them decided
right," he continued, adding that “stare decisis is not an end in
itself.”
Nancy Northup of the Center for
Reproductive Rights, in an interview with Politico, said, “Yesterday’s
Roberts court decision, which exhibited a stunning disregard for settled law
of decades’ standing, is terrifying to those of us who care deeply about the
constitutional protections the court put in place for women’s access to
abortion.”
“We are deeply concerned. ...
Yesterday’s decision shows the court will reach out to take an opportunity
to wholesale reverse a precedent the hard right has never liked.”
Pro-life advocates, on the
other hand, see a glimmer of hope that Roe v. Wade may indeed be overturned.
“Where they disagree with the precedent and they think it’s wrong
constitutionally, they’re not afraid to say it,” Jay Sekulow, an attorney
with the American Center for Law and Justice, told Politico. “Where
they think the court got it wrong, they’re trying to correct that, and from
my perspective that’s a good thing.”
"The Court correctly
concluded that judges should stop playing semantics with our Constitution and
read the text as it is written,” commented Penny Young Nance, CEO for
Concerned Women for America (CWA), on the day of the ruling. “The
government should not be limiting political speech because someone is rich or
poor, or because they disagree with a particular point of view. Americans are
the real winners today.”
The laws that have been
overturned, said CWA President Wendy Wright, “serve only to chill political
speech and open the door for those in power to choose favorites. We applaud
the Court for listening to the voices of millions of Americans who believe in
those foundational principles embodied by the First Amendment.”
"We hope this is just the
first in a series of steps to reclaim the ideals our Founders believed in when
they fought and died to establish a country where we can be truly free to
speak and worship our God without government interference,” she continued.

Faith in
Obama's Health Handling Hits New Low

- A new poll released by CBS News shows that public approval of President
Obama's handling of the health care overhaul has reached a new low.
In
the telephone poll conducted Jan. 6-10, only 36 percent of Americans said they
approve of Obama's handling of health care, while 54 percent disapprove.
Obama's
latest approval rating shows a six-point drop from last month, and is eleven
points lower than the 47% approval rating in October. Since then, the
atmosphere of high partisan tension dominating Congress has been reflected in
higher-than-average turnouts reported at town halls across America, where
citizens have been anxious to share deep misgivings about the health bill to
lawmakers at home for the recess.
The
latest Rasmussen poll on public approval of health care Monday showed the
majority of Americans opposed 55%-40%, a margin that has held fairly
consistent in recent weeks. Yet the margin of those who feel strongly
about the bill continues to grow wider: well over twice as many voters are now
strongly opposed to the bill as those strongly in favor, 54%-19%.
Democrat
lawmakers are courting a further wane in public approval polls as they
doggedly pursue final negotiations to merge the House and Senate versions of
the health bill in private. The entire Republican party and conservative
Democrat lawmakers have been shut out of the meetings - as well as C-SPAN
cameras, despite a petition from the network to allow full transparency for
the crucial negotiations.
Democrat
leaders are seeking to produce a bill that can pass both chambers and land on
President Obama's desk by some time in February, although leaders have grown
more reticent about setting a specific goal in recent days.

My confession:
I am a Jew, and every single one of my ancestors was Jewish. And
it does not bother me even a little bit when people call those beautiful lit
up, bejeweled trees, Christmas trees. I don't feel threatened. I
don't feel discriminated against.. That's what they are, Christmas trees.
It doesn't bother me a bit when people say, 'Merry Christmas' to
me. I don't think they are slighting me or getting ready to put me in a
ghetto. In fact, I kind of like it. It
shows that we are all brothers and sisters celebrating this happy time of
year. It doesn't bother me at all that there is a manger scene on display at a
key intersection near my beach house in Malibu . If people want a creche,
it's just as fine with me as is the Menorah a few hundred yards away.
I don't like getting pushed around for being a Jew, and I don't
think Christians like getting pushed around for being Christians. I
think people who believe in God are sick and tired of getting pushed around,
period. I have no idea where the concept came from, that America is an
explicitly atheist country. I can't find it in the Constitution and I
don't like it being shoved down my throat.
Or maybe I can put it another way: where did the idea come from
that we should worship celebrities and we aren't allowed to worship God as we
understand Him? I guess that's a sign that I'm getting old, too. But
there are a lot of us who are wondering where these celebrities came from and
where the America we knew went to.
In light of the many jokes we send to one another for a laugh, this
is a little different: This is not intended to be a joke; it's not
funny, it's intended to get you thinking.
Billy Graham's daughter was interviewed on the Early Show and Jane
Clayson asked her 'How could God let something like this happen?' (regarding
Hurricane Katrina). Anne Graham gave an extremely profound and
insightful response. She said, 'I believe God is deeply saddened by
this, just as we are, but for years we've been telling God to get out of our
schools, to get out of our government and to get out of our lives. And
being the gentleman He is, I believe He has calmly backed out. How can
we expect God to give us His blessing and His protection if we demand He leave
us alone?'
In light of recent events... terrorists attack, school shootings,
etc.. I think it started when Madeleine Murray O'Hare (she was murdered,
her body found a few years ago) complained she didn't want prayer in our
schools, and we said OK. Then someone said you better not read the Bible
in school. The Bible says thou shalt not kill; thou shalt not steal, and
love your neighbor as yourself. And we said OK.
Then Dr. Benjamin Spock said we shouldn't spank our children when
they misbehave, because their little personalities would be warped and we
might damage their self-esteem (Dr. Spock's son committed suicide). We
said an expert should know what he's talking about. And we said okay..
Now we're asking ourselves why our children have no conscience, why
they don't know right from wrong, and why it doesn't bother them to kill
strangers, their classmates, and themselves.
Probably, if we think about it long and hard enough, we can figure
it out. I think it has a great deal to do with 'WE REAP WHAT WE SOW.'
Funny how simple it is for people to trash God and then wonder why the world's
going to hell. Funny how we believe what the newspapers say, but
question what the Bible says. Funny how you can send 'jokes' through
e-mail and they spread like wildfire, but when you start sending messages
regarding the Lord, people think twice about sharing. Funny how lewd,
crude, vulgar and obscene articles pass freely through cyberspace, but public
discussion of God is suppressed in the school and workplace.
Are you laughing yet?
Funny how when you forward this message, you will not send it to
many on your address list because you're not sure what they believe, or what
they will think of you for sending it.
Funny how we can be more worried about what other people think of
us than what God thinks of us.
Pass it on if you think it has merit.
If not, then just discard it... no one will know you did... But,
if you discard this thought process, don't sit back and complain about what
bad shape the world is in.

The U.S. Senate just defeated
the Nelson-Hatch
amendment which would have blocked the government from
paying for abortions in the health care
reform bill.
What do you call it,

rights and freedoms, but one can easily follow the money-trail and see who is

name is Harold Estes, approaching 95 on December 13 of this year. People
meeting me for the first time don't believe my age because I remain

can't figure out what country you are the president of. You fly
around the world telling our friends and enemies despicable lies like:

arrogant" - (Your wife even announced to the world,"America is
mean-spirited. " Please tell her to try preaching that nonsense to 23
generations of our war dead buried all over the globe who died for no other
reason than to free a whole lot of strangers from tyranny and hopelessness.)
I'd
say shame on the both of you but I don't think you like America nor
do I see an ounce of gratefulness in anything you do for the obvious gifts
this country has given you. To be without shame or gratefulness is a

economy. That's not our greatest threat. Losing the heart and soul of who we

On My mind... what is happening to our country?
What do we call it when a government that is
elected by the people follows an agenda that pursues it's own interests,
contrary to the will and desires of it's people?
I call it interest-theft, whereby politicians
are so self interested that they ignore our interests, and needs, in favor of
being politically correct. They also keep their pockets full while they are at
it. Do not let them tell you that they don't, either.
For instance they, with the help of President
Obummer, are trying to make same-sex marriage normal. I am sorry, but as a
heterosexual male and as a Pastor, I cannot agree with this. Neither can most
of American Citizens! I'm sorry, but if God wanted our sexes to mingle, He
would have given us both sets of tools! This is just one of the changes that
our representatives are trying to force. Just look at what they are trying to
do to healthcare. I recently got flown from Prescott Valley Arizona to Phoenix
in a helicopter, after some one ran me off the road. the flight is charging me
$25,000... not counting $79,000 for medical fees from the
hospital! This is the type of healthcare they should be addressing, high
costs, not death panels, or abortion. when will this nonsense against
America's people end? I do not know, but I know we must be speaking out as a
nation against high medical costs. We must take a proactive stance. Now!

I've been reading your website
ministry for some time now. My wife got an abortion a few months ago, and
we're both not sure if we did the right thing. The sense of loss we are both suffering
is almost overwhelming, but your ministry has helped. I don't want to blame it
on anyone, but it was, after all her idea. I read about how one of your
readers was troubled by the economy, and we were in the same boat. The thing
is that it's done, and we can't un-do it. Please pray for us as we try to get
past this tragic mistake.

The State University of New York at Plattsburgh.
I am currently doing a story on the rights that men have when it
comes to the decision of their female partners having an abortion. So often
you hear that regardless of the views of the male it is the women who
has the final decision as to what to do with the pregnancy. I would really

Sadly, the
answer it all of your queries is no. Men have absolutely no say in the matter
of their children's survival. Roe V. Wade took care of that, and the mindset
of the modern women does not generally support rights for men. Perhaps this
will change, but it remains a sad place for men to be when their women are not
ProLife. All we have currently is prayer... and hope. Until this climate of
death changes we must practice safe sex if we want to prevent ourselves from
falling into the trap of despair from abortion, and loss of life.

I just had a chance to visit
your website, and man am I glad! I heard about you from the Amber May radio
show here in Phoenix. My wife just found out a few days ago that she's pregnant,
with our second kid, and
because I haven't had much work in the past year (self employed contractor)
and money has been really tight, she thinks we'd be better off having an
abortion. I don't know what I should say to her, except that I'm against that
idea. I just read your link on man to man, and I've gained a new strength
in how to talk to her. i've also gone to a couple of the other power point

I wake up
each day with a prayer on my lips.
I then spend
the day worrying, in fear, for our country. I tell myself to trust in God, but
I am mindful of free will, and free will is what troubles me. I pray that God
gives us guidance and direction, but then I get the feeling that The Lord has
given us just what we asked for—just what we deserve. This nation has
fallen. It has become as Sodom and Gomorrah.

A nation
where women have the choice to kill infants within the womb, and have done
so at the current rate of approximately one every 3 seconds—over
43,000,000 since Roe v Wade.

It is a nation where crime,
drugs and violence have become so every day, that the mainstream media
seems to report nothing else of value. Just watch the first ten minutes of
any news broadcast and you will see what unfolds.
In
light of all of this it is no wonder that some of us fall deep into a bottle
of booze, or needles and drugs… seeking to medicate, seeking a means to
escape, when our souls are so angered, weak and troubled.
There
is one way we can repair the damage to our nation: we require a spiritual
awakening… a return, en masse, to our fundamental need for God in our lives.
This may not be the answer everyone wants to hear, but it is the only answer
that will work. There is power in prayer, and strength in unity and
fellowship. Our path has been time tested, and laid out for us. We need only
embark upon it and we will succeed in not only finding answers, but finding
solutions that will heal our nation. May we find that the countless that have
sacrificed their lives for our nation will not have done so in vain.
